Autonomous systems must not make substantive legal decisions, provide independent legal advice, draft pleadings or advance legal proceedings without close human supervision and approval. AI may be used as a supervised technical aid, but full professional responsibility remains with the human lawyer. The position paper, signed by Adv. Menachem Moskowitz, states that lawyers bear personal responsibility for every action, decision or output produced with AI. Client confidential information must not be entered into open, unsecured platforms. Even closed systems require scrutiny of storage, access, encryption and interfaces. Simple anonymization is often insufficient. Prior informed client consent is required in many cases involving restricted information. The committee also warns against AI “hallucinations” that fabricate court rulings or citations.
